Acceptance of Terms

By accessing artekminds.com or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services. These Terms are governed by the Indian Contract Act, 1872 and applicable Indian law.

Description of Service

ArtekMinds provides AI workflow optimization, custom AI application development, document digitization, RAG implementation, secure LLM integration, and AI consulting for small and medium-sized enterprises (SMEs) in India and globally.

User Responsibilities

  • Provide accurate and complete information
  • Use our services only for lawful purposes and in compliance with Indian law, including the IT Act, 2000
  • Not attempt unauthorized access to our systems or infringe third-party rights
  • Maintain the confidentiality of any account credentials

Fees, Payment & GST

Fees are as set out in your service agreement or proposal. All fees are exclusive of applicable taxes, including Goods and Services Tax (GST), which will be charged at prevailing rates. Unless otherwise agreed in writing, fees are payable as invoiced and are non-refundable once work has commenced.

Intellectual Property

All website content, branding, and functionality are the property of ArtekMinds and protected under Indian and international IP laws. You retain ownership of the data and documents you provide. Custom deliverables are licensed or assigned to you as specified in your service agreement upon full payment.

Client Data and Confidentiality

You retain ownership of all data you share with us. We treat it as confidential, use it solely to deliver the services you request, and protect it per our Privacy Policy.

Service Availability

We aim for high availability but do not warrant that services will be uninterrupted or error-free. Services are provided on an "as is" and "as available" basis.

Limitation of Liability

To the fullest extent permitted by Indian law, ArtekMinds shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the fees paid by you for the specific service giving rise to the claim.

Indemnification

You agree to indemnify ArtekMinds against claims, losses, or expenses arising from your misuse of our services or breach of these Terms.

Termination

Either party may terminate services as set out in the service agreement. We may suspend access for conduct that violates these Terms or applicable law.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of India and, where applicable, resolved by arbitration under the Arbitration and Conciliation Act, 1996.

Changes to Terms

ArtekMinds reserves the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page.
